Prenuptial agreements in Nigeria: what they can — and cannot — do
Why couples use prenups, how Nigerian courts view them, and how to make one as effective as possible.
Prenuptial agreements are increasingly common, particularly where one or both partners own businesses, property or family wealth. In Nigeria they are useful — but they are not automatically binding on a court.
How courts view them
Under the Matrimonial Causes Act, the court retains discretion to make financial orders that are just and equitable. A prenuptial agreement is a relevant consideration, but the court is not bound to follow it — especially if it is unfair or was signed under pressure.
Making an agreement as robust as possible
- Sign well before the wedding, not days before.
- Make full and honest disclosure of assets and debts.
- Each party should take independent legal advice.
- Keep the terms fair and consider children’s needs.
- Review the agreement after major life changes.
What they are good for
- Protecting pre-marital businesses and family property.
- Setting clear expectations about finances.
- Reducing conflict if the marriage ends.
