EFCC vs ICPC: who investigates what

The EFCC and the ICPC are often mentioned in the same breath, but they are separate bodies with different statutes, focuses and ways of working. Knowing which one is involved helps you understand the likely direction of an enquiry.

Where they overlap

Many matters could fall within either agency’s remit — for example, where a contract involving a public body is alleged to have been obtained through bribery and the proceeds were then laundered. In practice, the agency that opens the file usually leads, though agencies can and do cooperate, and other bodies (such as the Nigerian Financial Intelligence Unit, the Police or the Code of Conduct Bureau) may also be involved.

Why it matters to you

  • Different offences, different defences. The statute that applies shapes what must be proved and what defences are available.
  • Different processes. Each agency has its own approach to invitations, statements, bail and plea discussions.
  • Asset measures. Both can seek orders against assets; the EFCC in particular frequently pursues freezing and forfeiture alongside investigations.

First steps, whichever agency it is

  • Verify the invitation through official channels.
  • Speak to a lawyer before engaging with investigators.
  • Preserve all documents and devices.
