Renting in Lagos: what landlords and tenants should know

Agreements, rent, repairs and ending a tenancy — the essentials of the Tenancy Law of Lagos State for both sides.

Most of Lagos is covered by the Tenancy Law of Lagos State 2011, which sets out rights and obligations for landlords and tenants. (Some high-value areas are excluded, and other states have their own laws.)

Put it in writing

A written tenancy agreement avoids most disputes. It should cover the rent, the term, service charges, who handles repairs, and how either side can end the tenancy.

Rent and receipts

  • The Law restricts how much rent in advance a landlord may demand, particularly from sitting tenants.
  • Landlords should issue receipts for every payment; tenants should keep them.
  • Rent increases should follow the agreement and proper notice.

Repairs and quiet enjoyment

Tenants are entitled to quiet enjoyment of the property. Landlords should not enter without notice except in emergencies, and each side should meet the repair obligations in the agreement.

Ending a tenancy lawfully

  • The correct notice to quit depends on the type of tenancy — for example, six months for a yearly tenant.
  • After it expires, a seven-day notice of the owner’s intention to recover possession is served.
  • If the tenant stays, the landlord must go to court. Forcible eviction, removing roofs or cutting utilities is unlawful.
